I. Use of Website

You undertake to carefully read all product packaging and labels prior to use. You may consult your dermatologist before exposing yourself to any goods being offered in this site.
The contents of this online store are provided “as is.” Pervil Cosmetics Philippines, Inc., its affiliates, partners, agents and/or suppliers make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Furthermore, Pervil does not warrant or make any representations concerning the accuracy, likely or desired results, or reliability of the use of the goods. If at all, Pervil, its affiliates, partners, agents and/or suppliers only liability is to replace the goods found to be defective or reimburse/credit you the equal amount of the purchase price of the goods. In no event shall Pervil, its affiliates, partners, agents and/or suppliers be liable for any special, consequential, indirect, exemplary or incidental damages whatsoever resulting from the use of the goods or availing of the services being offered, whether such claim is based on contract, tort (including negligence), product liability or otherwise, even if advised of the possibility or likelihood of such damages.
Customer warrants that the purchase of the products will not violate any laws. As such, Customer hereby holds Pervil free and harmless from any and all loss or damage arising from or in connection with the breach of this warranty by the Customer.
Pervil’s obligation ends upon delivery of the products to customer’s specified shipping address and shall not be responsible for shipment to be made thereafter, including to foreign destination.
The terms and conditions shall be governed by the laws of the Republic of the Philippines, without regard to its conflicts of laws principles. Any legal action or proceeding related to this shall be brought before the appropriate courts in Quezon City, Philippines, to the exclusion of all other courts.
II. PRODUCT AVAILABILITY
The merchandise available on this online shop may be obtained from the following: actual brand manufacturers or authorized distributors/resellers.
As a brand owner or reseller, this online shop reserves the right, without need for prior notice, to revise, discontinue or cease to make available any and/or all products. Should this online shop be unable to supply you with a product you have ordered and paid for, an alternative product will be offered or a full refund issued.
Prices are VAT inclusive (12%). This online shop reserves the right to modify the prices of the products available on its site at any time, without prior notice.
pervilcosmetics.ph/ accepts the following payment methods:
- Over-the-counter bank deposit: BDO or Chinabank
- Cash-on-delivery (COD)
V. DEFECTIVE, DAMAGED OR UNSUITABLE PRODUCTS
If within 7 days after a product is delivered to you, and the product is subsequently deemed defective, you are entitled to a replacement of the same product or another product/s with equivalent value.
Please note that the following conditions will NOT render the product damaged, defective or unsuitable as aforesaid and will not entitle you to replacement.
a. Damage caused by normal wear and tear
b. If the product has been dealt with or used contrary to the manufacturer’s instructions
c. Where you or someone unauthorized to do so has altered or damaged the product
VI. RETURNS AND REPLACEMENT
Should you not be satisfied with any product you purchased from this online shop by reason of a defect, incorrect choice of product, you may, under certain circumstances, be entitled to a refund or replacement, as the case may call for. Please take note that you have to report the issue to firstname.lastname@example.org within 7 days after the delivery date.
This online shop will perform the product evaluation within 7 business days after receipt of the report. For qualified returns, Pervil may offer an alternative product. However, an exact product replacement cannot be guaranteed. Should Pervil be unable to produce an exact replacement, Pervil will issue a full refund.
Refunds will be offered in the form of checks.
Your order will be dispatched within 4 to 5 working days after approval of order and payment is received. Transit time is 2 to 3 business days.
IX. LATE DELIVERY
We make every effort to deliver goods within the said period.
Pervil is not liable for any reasonable amount of delay in the delivery of your purchase due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes or labor disputes, embargoes, government orders or any other force majeure event.
